Property Transfer Taxes in Pakistan Explained: 236K, 236C, Stamp Duty, CVT and Society Fees

The agreed price is never the full cost of a property deal. Between federal withholding taxes, provincial duties and the society’s own fee, both buyer and seller pay a noticeable amount on top — and the amount can change sharply depending on filer status. This guide explains each charge, who normally pays it and how to budget for it.

We deliberately do not quote fixed percentages here: federal rates are revised in each Finance Act and provincial rates change too, so any number printed today can be wrong by the time you transfer. Our Transfer Taxes & Fees calculator shows the structure with editable rates — enter the current ones for an exact estimate.

Taxes and fees paid by the buyer

Advance tax on purchase — section 236K

Collected by FBR at the time of registration or transfer, on the purchase of immovable property. The rate depends on the value of the property and on whether the buyer appears on the Active Taxpayers List (ATL). Non-filers are charged substantially more. It is an advance tax — a filer can adjust it against their final tax liability when filing a return.

Stamp duty

A provincial levy on the transfer or sale deed, charged as a percentage of the property’s value. It is paid to the provincial government, not FBR, and the applicable rate depends on the province and the kind of area.

Capital value tax (CVT)

A provincial tax on the value of certain property transactions. Whether it applies, and at what rate, depends on the province and the type and location of property.

Society transfer fee

Every housing society charges its own fee to record a change of ownership, and may also require clearance of dues, a no-demand certificate and verification of both parties in person. Ask the society office for its current schedule.

Registration and incidental costs

Registration charges, documentation, and the cost of the deed and attestation are usually small but should be budgeted.

Taxes paid by the seller

Advance tax on sale — section 236C

Collected by FBR on the sale or transfer of immovable property, again at a rate depending on value, holding period in some cases, and filer status.

Capital gains tax

Gains on disposal of immovable property may be taxed depending on how long the property was held and the law in force at the time. Seller advance tax under 236C is typically adjustable against it for filers.

Which value is tax charged on?

Taxes are usually calculated on the higher of the declared price and the official valuation — the FBR valuation table for the area, or the provincial (DC) rate. Under-declaring the price does not reduce the tax below the official valuation, and it creates problems for the buyer later when they sell.

Why filer status matters so much

For both 236K and 236C, the rate for people who are not on the Active Taxpayers List is considerably higher than for filers. Before a transaction:

  1. Check your status on FBR’s Active Taxpayers List.
  2. If you are not on it, consider filing before the transfer — the saving can be significant on a large purchase.
  3. Make sure the name and CNIC on the tax payment match the transfer documents exactly.

Agent commission

Commission is not a tax, but it is part of the cost. In the Twin Cities it is commonly negotiated as a percentage from each side. Agree the amount and who pays it in writing before you start viewing — our guide to buying safely through property dealers covers this.

A worked approach to budgeting

  1. Find the tax value — the higher of the agreed price and the official valuation.
  2. Get today’s rates for 236K, 236C, stamp duty and CVT from FBR, the provincial revenue department or a tax adviser, for your filer status.
  3. Add the society transfer fee from the society office.
  4. Add commission as agreed.
  5. Enter them in the calculator to see the buyer’s and seller’s totals side by side.

Plan the budget before you pay a token amount. Buyers should then check what they can comfortably afford with the Affordability calculator, which assumes the transfer costs come on top of the price.

Common mistakes

  • Assuming the seller pays everything. By default each side pays its own taxes; anything else must be agreed in writing.
  • Paying tax in a different name. The payer’s CNIC must match the transfer documents, or the payment may not be accepted.
  • Forgetting society dues. Unpaid maintenance or development charges usually have to be cleared before the society records the transfer.
  • Relying on last year’s rates. Check after every budget.
